On 5 August 2026, the Thai Cabinet approved Prime Minister’s Office Regulation on the Data Center Business Policy Committee ("Committee"), which was published on 13 August 2026 in the Government Gazette and has been effective since the same date. The Committee will be responsible for proposing policies, standards, and frameworks for regulatory approvals relating to data center operations, including telecommunications licenses, investment promotion, and other related permits.
泰國內閣於2026 年 8 月 5 日核准關於成立「資料中心業務政策委員會」(簡稱「委員會」)的總理府規章,該規章已於 2026 年 8 月 13 日刊登於政府公報,並自同日起生效。該委員會將負責提出與資料中心營運相關的監管審批政策、標準與框架,包括電信執照、投資促進以及其他相關許可。

1. Data Center means any facility that operates computing hardware to manage, store, process, host, or transmit digital information for unaffiliated third parties, as specified by further regulations.
資料中心係指依後續法規規範,為非關係企業之第三方營運計算硬體,以管理、儲存、處理、託管或傳輸數位資訊之任何設施。
2. Members of the Committee include a deputy prime minister designated by the prime minister, and will have three vice-chairs comprising the ministers of digital economy and society, interior, and energy. The committee also includes 12 ex-officio members.
委員會成員包括由總理指定的一名副總理,並由數位經濟與社會部、內政部及能源部等三位部長擔任副主席。委員會另包含 12 名當然委員。
3. The empowerment of the Committee to conduct impact assessments on data center businesses.
委員會獲授權對資料中心業務進行影響評估。
4. The requirement that data center policies, standards, and frameworks take into account factors such as Thailand's economy, clean energy usage, energy security, efficient consumption of electricity and water, town planning, and public safety.

In addition, the Committee is authorized to:

1. Formulate policies, standards, and operational guidelines for government agencies regarding the approval, licensing, granting of investment incentives, or provision of services for data center operators in Thailand;
擬定政策、標準與營運指南,供政府機關在核准、發照、給予投資優惠或向泰國資料中心營運業者提供服務時遵循;
2. Assess, track, and report on the impacts of data center operations to the cabinet;
評估、追蹤並向內閣報告資料中心營運所帶來的影響;
3. Establish sub-panels or working groups to execute designated duties; and

4. Execute additional responsibilities assigned by the cabinet or the prime minister.

Currently, Thailand does not have a dedicated law governing data center operations. Instead, data centers are regulated through a range of generally applicable laws and regulations, including those relating to building control, land use, construction, foreign business operations, and telecommunications licensing.
Investors in Thailand should prepare for a shifted regulatory landscape marked by centralized and heightened government oversight. With the establishment of the Committee, prospective investments will be subjected to evolving national standards across multiple domains, including clean energy transition, resource efficiency (electricity and water), data sovereignty, and public safety. Furthermore, given the broad statutory definition of a "data center," operators must closely monitor upcoming policy frameworks and potential changes to licensing and BOI incentives to ensure ongoing compliance.
目前,泰國尚無專門規範資料中心營運的法律。取而代之的是,資料中心受一系列普遍適用的法律與法規監管,包括與建築物管制、土地使用、建設、外國人投資事業營運以及電信執照相關的規定。
在泰國的投資人應為以集中化與嚴格化政府監管為特徵的法規環境轉變做好準備。隨著委員會的成立,未來的投資將面臨跨多個領域且不斷演進的國家標準,包括清潔能源轉型、資源使用效率(電力與水資源)、資料主權以及公共安全。此外,鑑於「資料中心」的法定定義相當寬泛,業者必須密切關注即將推行的的政策框架,以及許可發放和 BOI投資優惠的潛在變革,以確保持續符合合規要求。
